The First Amendment Takes Another One on the Chin

This time, via the Federal Election Commission. Back in 2004, NASCAR Nextel Cup driver Kirk Shelmerdine had a “Bush/Cheney 2004” sticker on the rear quarter panel of the car for 4 of the final 10 races of the 2004 season. The placement of the sticker was not authorized by the Bush/Cheney campaign, nor did the campaign pay to have Shelmerdine display the decal. Because Kirk Shelmerdine Racing is a Limited Liability Corporation, a complaint was filed with the FEC:

… complaint the FEC received from one Sydnor Thompson that Kirk Shelmerdine had improperly committed an independent expenditure on behalf of the Bush-Cheney re-election campaign during the 2004 race.

This complaint mentioned that there was no disclaimer that Kirk was displaying the decals of his own volition, and sought some huge fines and penalties.

OK, let me tell you about Kirk Shelmerdine. I’ll always remember him as the crew chief for the late, great Dale Earnhardt. Kirk always wanted to go racing on his own, and left Richard Childress Racing several years back. Kirk’s team is drastically underfunded; car sponsors, when they are to be found at all, are not high rollers themselves, nor are they usually repeat sponsors. So Kirk, sponsorless for the 4 races in question, put the Bush/Cheney decals on the car to draw attention to himself, his car, and his race team, in hopes of attracting sponsorship money. The very fact that he even occasionally makes the field of 43 is remarkable. He never runs particularly well, but even 40th place money is a bunch to someone who can squeeze the nickels he way he can; he’s eking out a living, and doing what he wants.

Back to the complaint in question; the FEC spent months trying to value the space on the car that was occupied by the offending decals. As a market guy, I can tell you: zero. The simple fact that no sponsors stepped up for any of these races should indicate the space’s value. And, does anyone really think that had some sponsor offered him $50K to carry their signage, that Kirk would still have had Bush/Cheney decalomania on the car for free? Kirk’s a businessman, I’m sure he can do the math. With no sponsors, he put the campaign materials on his car as a statement.

So after months of FEC hand-wringing and navel-gazing, they let Kirk off with something called a “letter of admonishment”, which means “we think we could have fined the shit out of you, but we’ll cut you some slack this time. Pull that crap again, and we’ll whack you in the wallet.”

From Mark Tapscott’s post. which was quoted briefly above, these observations:

If you still wonder why I believe this case is so important, think about this: What is the difference between Kirk Shelmerdine’s race car as his equipment for making a living and the pickup truck driven by the plumber or housing contractor?

The contractor with a Kerry-Edwards or Bush-Cheney bumper sticker on his back bumper and driving down I-95 or just about any other public road in America will be seen by far more people than Shelmerdine’s “field filler” race car at four NASCAR events.

It’s the same “independent expenditure,” but it has more impact than the Shelmerdine sticker, so what’s to keep Congress from next directing the FEC to “admonish” every contractor, plumber, electrician, etc. etc. in America to get those bumper stickers off their pickups?

Indeed. It looks like we’re entering yet another “Year of the Chickenshit.”

Fantasizin’ Again

There’s a Fantasy Cup One Race Challenge for this weekend’s Ford 400, from Homestead-Miami. Over $21,000 in cash and prizes. Hmm … a Free entry in the challenge if you renew your team for 2007, plus an early signup bonus for next year.

I think I’ll pony up again, as much as I’ve cussed my sad sacks this year. Add the one-race challenge, which is its own entity, and I’ll have a backup set of sad sacks to cuss.

I’m just a glutton for punishment.

Finally Fantasizin’

I’ve been pretty quiet about my Fantasy Cup Racing Team here lately, and with good reason; I haven’t been doing worth a patooter.

I can attribute my decline to a spate of mid-season greed, where I had racing dynasty on the brain and lots of trade tokens to spend. I traded a bunch of perfectly good guys for a group that had potential; unfortunately this potential didn’t translate to on-track performance. Out of trade tokens, and unwilling to buy anymore for this season, I determined to finish out the season with the team I had. And I was somewhat rewarded today, finishing on the north side of 1000 points for the first time in weeks. Not a major victory, but enough of a late season boost to make me want to play again next year.

And hats off to my favorite, Kevin Harvick, on winning the Checkers 500 from Phoenix this afternoon.

So Long, Texas Terry

The green flag is about to drop on the Dickies 500 at Texas Motor Speedway. This marks the last race for Terry Labonte, two time NASCAR champion. He starts his 848th NASCAR Cup event today, and will hang up his helmet after a long and storied career.

He’s seen many changes to racing in his nearly 30-year NASCAR career. I’ve always liked his style; I can remember races where his name wasn’t mentioned until the last 50 laps, where he apparently came from nowhere to be in the top 10 or top 5, with an excellent chance at the win. Cool, calm, that is Terry.

While his NASCAR championships have to top his accomplishments, I’ll always remember the last real Southern 500, run as it should be, in the Labor Day heat and humidity in Darlington SC. An old-school win at an old-school track, by an old-school guy. Racin’ the way it was meant to be.

ARCA Racin’

SWMBO and I watched the tape-delayed ARCA race from Talladega last night. This race featured the much-heralded debut of former F1 driver and Indy 500 champ, Juan Pablo Montoya. And what a race it was, what there was of it.

Because of the late start, and because Talladega has no track lights, the event was shortened from 94 to 81 laps, or about 35 miles short of the planned distance. Called on account of darkness, in other words. The last 20 or so laps on a restrictor plate track are usually among the most dramatic in motorsports; I felt gypped as a fan watching on teevee; I would have been totally ballistic had I paid good money for a ticket.

Suggestion to ARCA officials: Start the race earlier. Not exactly rocket science.

Summer Racing Spectacle

Tonight, a half-hour hence, the Sharpie 500 from Bristol Motor Speedway. I’ve never been to Bristol, but 165,000+ people around a half mile high banked concrete track, just warms the cockles of my heart.

I hope to attend this event at some point. I’d need luck in acquiring tickets; Bristol sells out early and consistently.

I would also prefer to be 25 or 30 years younger, so I could enjoy the event with the proper breakfast whiskey. This isn’t happening, so if I really want to go there(and I do), I’ll probably buy tickets/transportation from a NASCAR tour group. Bus fumes don’t bother me. Not having to drive out of such a venue bothers me less.

After a magnificent meal with friends, after which I’m wearing as much barbecue sauce as I’ve consumed, SWMBO and I are watching the Knoxville(IA) Nationals sprint car race on Speed TV. Dirt track racin’, the way it was meant to be.

Get Well, Benny Parsons

Benny Parsons, NASCAR Winston Cup Champion in 1973, has been diagnosed with lung cancer, and will begin immediate treatment.

Benny is currently an analyst on NBC/TNT’s NASCAR coverage, and also hosts a racing-related show “Fast Talk with Benny Parsons”, on PRN Radio.

Amazingly, according to the article:

He plans to continue his duties with NBC/TNT and PRN throughout his treatment.

All my prayers and best wishes go out to Benny for successful treatment and recovery.

Oh, Well

The checkered flag has flown at Dover, and Matt Kenseth gets the tbbs-land congratulations on the victory. In the coulda’, woulda’, shoulda’ category, my fantasy team finished with 1134 points, a respectable effort. If I’d traded Tony Stewart, I would have had another 59 points (Greg Biffle being my choice for Tony), which would have put me in near-stratospheric levels for this race. At least my best-ever effort.

As it ended, though, I had a decent showing, and I earned 100 more pit bonus points on the day. At this rate, I’ll probably be racing free in 2007, if I can apply the pit points toward next year’s fee.
